1. About us
This website is operated by Tristan Wood, trading as Scribble & Keep (a sole trader), 96 Lumley Rd, Skegness, PE25 3ND, United Kingdom, hello@scribbleandkeep.co.uk. We are not VAT registered.
2. These terms
These terms apply to every order placed on scribbleandkeep.co.uk. Please read them, together with our Refund & Returns, Shipping and Privacy policies, before you order. If you're a consumer, nothing in these terms affects your statutory rights.
3. Orders and contract
After you order, you'll get an email confirming we've received it. The contract between us is formed when we send that confirmation. After you send your drawing, we'll email you a proof, and we only print your order once you approve it. We may refuse or cancel an order (with a full refund) if the artwork breaks section 5, if there's a pricing error, or if we can't fulfil it.
4. Prices and payment
Prices are in pounds sterling. VAT is not charged (we are not VAT registered). Delivery is shown at checkout. Payment is taken when you place your order.
5. Your artwork
- You confirm that you own, or have permission to use, the artwork you send. It should be by your child or family member, or you should otherwise have the right to reproduce it.
- You keep all rights in the artwork. You give us a limited licence to copy, edit (clean-up only) and print it, and to share it with our print partner, solely to fulfil your order and handle remakes.
- We won't use your artwork for marketing without your separate, explicit permission.
- We may refuse artwork that infringes someone else's rights (for example, copied characters or logos), or that's offensive or unlawful.
6. What we do to the artwork
We digitally clean the image by removing the background, creases, shadows and marks and adjusting colour and brightness. We don't redraw the artwork. We email you a proof, and you approve it before anything is printed. The colours of printed items may differ a little from screens and from the original paper, and that isn't a fault. Print quality depends on the photo you send. If we think it's too low, we'll tell you before printing.
7. Delivery
Delivery estimates are in our Shipping Policy. Risk in the goods passes to you on delivery. If an item hasn't arrived within 30 days of the order being dispatched, contact us and we'll replace it or refund you.
8. Cancellations, returns and faulty goods
Because items are personalised, the 14-day cancellation right doesn't apply (Consumer Contracts Regulations 2013, reg. 28(1)(b)). You can still cancel for a full refund before you approve your proof. Your rights for faulty or incorrect goods under the Consumer Rights Act 2015 aren't affected. See our Refund & Returns Policy.
9. Our liability
We're responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We aren't responsible for loss that wasn't foreseeable. We don't exclude liability where it would be unlawful to do so, including for death or personal injury caused by negligence, for fraud, or for breach of your statutory consumer rights. Our products are for domestic and private use.
10. Events outside our control
We aren't liable for delays caused by events outside our reasonable control, such as postal strikes, severe weather or supplier outages. We'll tell you, and you may cancel for a refund if the delay is significant and production hasn't started.
11. Website use
Content on this site (other than your artwork) belongs to us or our licensors. You may not misuse the site, attempt to access it without permission, or upload malicious material.
12. Complaints and disputes
Please contact us first at hello@scribbleandkeep.co.uk and we'll try to resolve things quickly. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
13. Changes
We may update these terms. The version in force when you ordered applies to your order.
